I. Privacy policy

We, fischer USA (hereinafter referred to as "we" or "fischerwerke"), are pleased that you have visited our website and are interested in our company and our products and services.

We attach the utmost importance to the protection of your privacy as a user of our website and, when processing personal data, we comply with the provisions of the data protection legislation applicable to us.

As the controller, we have implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through this website.

However, Internet-based data transmissions can always be subject to security vulnerabilities, so that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by post.

II. Responsible

fischer USA

IV. Subject and basis of data protection

The subject of data protection is personal data. This is all information that relates to an identified or identifiable natural person (so-called data subject). This includes, for example, details such as name, postal address, e-mail address or telephone number, but also information that necessarily arises during the use of our website, such as information about the beginning, end and extent of use and the transmission of your IP address.

We process personal data in compliance with the relevant data protection regulations. This means that your data will only be processed by us if you have given your consent or if we are legally permitted to do so, e.g. if data processing is necessary to provide our contractual services (e.g. processing orders) or is required by law, or on the basis of our legitimate interests as defined in Art. 6 (1) f) DSGVO (e.g. our interest in analyzing, optimizing and securely operating our online offering).

We take organizational, contractual and technical security measures in accordance with the state of the art to ensure that the data protection regulations are complied with and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.

V. Data processing when calling our website

The use of our website is generally possible without registration and without providing personal data. Even if you use our website in this way for purely informational purposes, however, personal data may be automatically collected and processed. Below you will find an overview of the type, scope, purposes and legal basis of data processing via our website.

V.1. Provision of our website

When you access our website through your terminal device, we automatically record and process the following data in the server log files:

  • Date and time of access
  • Duration of the visit
  • type of terminal device
  • operating system used
  • the functions you use
  • amount of data sent
  • type of event
  • referrer URL
  • domain name
  • IP address

We process this data on the basis of our legitimate interests within the meaning of Art. 6 (1) f) DSGVO, namely to provide and display the website, to ensure and maintain technical operation, for the purpose of identifying and eliminating malfunctions, and for security reasons (e.g. to investigate cases of abuse or fraud). When you call up our website, this data is automatically processed. Without this provision, you cannot use our website. We do not use this data for the purpose of drawing conclusions about your identity.

The collected data is usually deleted after 28 days, unless we exceptionally need it longer for the above purposes. In such a case, we delete the data immediately after the purpose ceases to apply.

V.2. Display Technologies

On this website, we use Ajax and jQuery technologies, which optimizes loading speeds.
If your browser does not support these technologies, a default font is used by your computer.

V.3. Cookies

In order to offer you an extensive range of functions on our website, to make its use more comfortable and to be able to optimize our offers, we use so-called "cookies". Cookies are small text files that are stored on your end device or its hard drive assigned to the browser you are using and through which certain information flows to the provider. Cookies cannot execute programs or transfer viruses to your end device. They are primarily used to make websites more user-friendly and effective overall. We use cookies for different purposes and with different functions. Here, we differentiate according to whether the cookie is technically mandatory, how long it is stored and used, and whether it was set by our website itself or by third parties.

We use certain cookies because they are mandatory for our website and its functions to work properly ("Necessary" cookies). These cookies are set automatically when you access our website or a specific function, unless you have prevented cookies from being set by making the appropriate settings in your browser. In contrast, non-essential cookies are set (e.g. in the "Statistics" area), for example to improve the comfort and performance of our website or to save certain settings you have made. We also use such cookies to gather information about the frequency of use of certain areas of our website so that we can tailor them more specifically to your needs in the future.

Most cookies are only required for the duration of your current service call or session and are then deleted again or lose their validity as soon as you leave our website or your current session expires (so-called "session cookies"). Only occasionally are cookies stored for a longer period of time, for example to recognize you when you return to our website at a later time and to access stored settings (so-called "persistent cookies"). This enables you, for example, to access our website more quickly or more conveniently or to avoid having to make certain settings again. Persistent cookies are automatically deleted after a predefined period of time, which may vary depending on the type of cookie and its function, when you visit the page or domain from which the cookie was set.

So-called "third-party cookies" are set and used by other entities or websites, for example by providers of web analytics tools. More information on web analytics tools and reach measurement is provided later in this Privacy Policy. Third-party providers may also use cookies to display advertising or to integrate social network content (so-called "personalization").
To make it easier for you to deal with cookies on our website, we have implemented the extended cookie notice banner Cookiebot of the provider Cybot A/S, Havnegade 39, DK-1058 Copenhagen, Denmark ("Cookiebot"). The cookies necessary for the functions of the Internet pages and the services offered are preset. In this respect, data processing is therefore carried out to protect our legitimate interests on the basis of Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest is the provision and maintenance of our online offer. For further details, please refer to the passages below under items 3.4 - 3.10.
By unchecking the box, you can prevent cookies from being set in the relevant category (e.g. "Statistics", "Personalization"). However, if you allow us to use statistics (analytics services such as Google Analytics) and personalized content (recognition of your page views with us and with advertising partners or social media providers such as LinkedIn), we can inform you individually in the usual way, remind you of content you have already viewed and optimize our websites based on the anonymous analysis of your user behavior on our pages and in our services and platforms.

Cookiebot is therefore used to provide you with a quick overview of the cookies used on the website and to give you the opportunity to make individual settings regarding the setting and use of cookies. For more information about Cookiebot, as well as Cybot's privacy policy, please see the following link: https://www.cookiebot.com/de/privacy-policy/. You can find more information about the categories and the applicable settings for these in the cookie banner on our website.
You can see a list of the cookies used on our website here: https://www.fischer-international.com/en/legal-notes/cookie-declaration.

The acceptance of cookies when using our website is therefore not mandatory overall. If you generally do not want cookies to be used, you can also prevent cookies from being stored on your end device by setting your browser accordingly. Please note that this may restrict the functionality and scope of functions of our website. You can delete stored cookies at any time in the system settings of your browser. For detailed information on the type, scope, purposes, legal basis and revocation and objection options for data processing with cookies, please refer to the following descriptions of the individual functions that are based on the use of cookies.

V.4. Analysis services

In order to optimize the services and functions of our website and to be able to offer them in the best possible way, we carry out the analyses of visitor behavior described below. The purpose of the data processing is, in addition to troubleshooting, primarily the optimization of our website with regard to the needs of the users. We also obtain key figures about the volume of visitors and their distribution over time, about popular content and the length of time users spend on the site via the web analysis process. It may also be possible to determine whether a user profile was created as a result of an advertising measure. The data is processed and used to prevent and combat fake profiles, illegal activities and spam, and to increase the security of the website. To perform the analysis, user data is transmitted to various third-party providers as described here in the privacy policy.

a) We use Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google") on the Website. Google uses cookies, the information generated by the cookie about the use of the online offer by users is usually transmitted to a Google server in the U.S. and stored there. Google uses this information on our behalf to evaluate the use of our website, to compile reports on the activities within our online offer and to provide us with other services related to the use of our online offer. In doing so, pseudonymous usage profiles can be created from the processed data.

We only use Google Analytics with IP anonymization activated. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser will not be merged with other data from Google.

The data processing associated with Google Analytics takes place on the basis of your consent pursuant to Art. 6 para. 1 lit. a ) DSGVO.

When considering this, it should also be noted that acceptance of Google Analytics is not mandatory when using our website. If you do not want cookies to be stored by Google Analytics on your terminal device, you can prevent this through Your privacy settings in the "Statistics" category (Here you will be taken to the corresponding cookie settings). You can also disable the corresponding option in the system settings of your browser. You can delete stored cookies in the system settings of your browser at any time. In addition, you can disable the use of Google Analytics cookies using a browser add-on if you do not want the website analysis. You can download this add-on here:
http://tools.google.com/dlpage/gaoptout?hl=de.

Using the browser add-on to disable Google Analytics, you can prevent Google Analytics from using their data. If you want to disable Google Analytics, download and install the add-on for your web browser. The Google Analytics opt-out add-on is compatible with popular browsers. For the add-on to work, it must be loaded and run correctly in your browser.

The data processed within the scope of Google Analytics will - according to Google's own information - be deleted after 14 months. Insofar as data is transferred to the USA, so-called standard contractual clauses in accordance with Art. 46 DSGVO for Google advertising services have been concluded with Google as suitable guarantees(https://privacy.google.com/businesses/processorterms/mccs/ ). Google is also certified under the Privacy Shield agreement. Further information on data use by Google, setting and revocation as well as objection options, can be found in Google's privacy policy at: https://policies.google.com/privacy.

b) We use Hotjar, an analysis software of Hotjar Ltd, 3 Lyons Range, 20 Bisazza Street, Sliema SLM 1640, Malta ("Hotjar"), to better understand the needs of our users and to optimize our offer. Using Hotjar's technology, we get a better understanding of our users' experiences (e.g., how much time users spend on which pages, which links they click, what they like and don't like, etc.) and this helps us tailor our offering based on our users' feedback. Hotjar works with cookies and other technologies to collect information about our users' behavior and their devices, in particular

  • IP address of the device (collected and stored only in anonymized form)
  • Screen size
  • Device type (unique device identifiers)
  • Information about the browser used
  • Location of the user (country only)
  • language preferred for viewing our website.
  • Offers requiring registration, newsletters and communication

Hotjar stores this information in a pseudonymized user profile. The information is not used by Hotjar or us to identify individual users or merged with other data about individual users. Instead, we use Hotjar for the purpose of analyzing the use of our website and to be able to continuously improve individual functions and offers as well as the user experience. Through the statistical evaluation of user behavior, we can improve our offer and make it more interesting for you as a user. The data processing is based on your consent in accordance with Art. 6 para.1 lit. a) DSGVO.

If you do not want cookies to be stored by Hotjar on your terminal device, you can prevent this through your privacy settings in the "Statistics" category(Click here to access the corresponding cookie settings).

You can also prevent Hotjar from storing a user profile and information about your visit to our website, as well as from setting Hotjar tracking cookies on other websites via this link: https://www.hotjar.com/legal/compliance/opt-out.

For more information about Hotjar's use of data, setting and revocation and opt-out options, and data protection, please see the following Hotjar website: https://www.hotjar.com/legal/policies/privacy.

V.5. Social media and social networks

The website contains links to our accounts on social networks such as Instagram, YouTube, Twitter and Facebook. After clicking on the embedded graphic, you will be redirected to the page of the respective provider, i.e. only then will user information be transmitted to the respective provider. If you are logged into the corresponding social network with your user profile, an association with the visit to our website takes place after activating the button. If you do not want the social networks to collect data about the website, you should log out of them accordingly before visiting the website.

We maintain publicly accessible profiles in social networks and process user data in this context in order to communicate with users active there or to offer information about us, currently at:

With our various social media channels, we would like to offer you a wide range of multimedia services, present our products to you comprehensively, and exchange ideas and inquiries with you on topics that are important to you. In this context, data processing serves the following purposes in particular:

  • Presentation of our company and corporate culture, including existing career and further training opportunities at fischerwerke.
  • Comprehensive product advice, answering customer and prospective customer inquiries about technical details, possible applications and further background information
  • Communicating with and informing social media channel visitor(s); presenting current events and happenings including online seminars
  • Collect statistical information on social media channel reach;
  • Conducting customer surveys, marketing campaigns, market analysis, sweepstakes, contests, or similar promotions or events;
  • Resolving disputes and litigation, establishing, exercising or defending against legal claims or litigation, enforcing existing contracts.

The legal basis for the processing is, unless explicitly stated otherwise, Article 6 (1) lit. f) DSGVO. Our legitimate interest is to be able to present our company and the offers you request on the channels you prefer and to respond quickly to your messages or inquiries. In addition, we have a legitimate interest in analyzing the reach and use of our social media channels in order to achieve an appropriate design and continuous optimization. Insofar as you wish to enter into a contractual relationship with fischerwerke with your request, the legal basis for this processing is Art. 6 (1) lit. b) DSGVO.
If we intend to process your personal data for a purpose other than the one mentioned above, we will inform you accordingly before processing.
We would like to point out that this may involve processing users' data outside the area of the European Union. This may result in risks for users because, for example, it could make it more difficult to enforce users' rights.
We process the following personal data in particular through our social media presences:

  • Your social network username and comments posted on our social presences and messages sent by you through our social networks.
  • Your activity on our social networks via the respective service of the providers (esp. Facebook Insights, Instagram Insights, Twitter Analytics, statistical information on LinkedIn, "Analytics" on YouTube), i.e. e.g. visits to the social presence, the amount of interactions, visits and average duration of video playbacks, information about which countries and cities our visitors come from and statistics about the general relationships of our visitors.
  • Other information necessary to respond to requests from our visitors or to uniquely identify our visitors in our systems.
In addition, when you visit one of our social media sites, the operators of the social media portals may create user profiles in which your preferences and interests are stored. In this way, you can be shown interest-based advertising inside and outside the respective social media presence. Provided you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are or were logged in.
Please note that we cannot track all processing on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and data protection provisions of the respective social media portals (see above).
If you visit one of our social media sites, we may be jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. Joint responsibility within the meaning of the GDPR arises in particular for
  • the use of statistical information on Facebook ("Facebook Insights "), whereby Facebook provides us with data in anonymized form and conclusions about individual users and access to individual user profiles by us are not possible. Further information can be found here: https://www.facebook.com/legal/terms/information_about_page_insights_data. fischerwerke and Facebook have concluded a so-called joint responsibility agreement: https://www.facebook.com/legal/terms/page_controller_addendum.
  • the use of statistical information at LinkedIn ("LinkedIn Analytics "), whereby LinkedIn only provides us with data in anonymized form via this service and conclusions about individual users and access to individual user profiles by fischerwerke are not possible. fischerwerke and LinkedIn have therefore concluded a so-called joint responsibility agreement: https://legal.linkedin.com/pages-joint-controller-addendum.

In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. vis-à-vis Facebook or LinkedIn), although we would like to point out that these can most effectively be asserted against the providers. Only the providers have access to the users' data in each case and can take appropriate measures and provide information directly. If you still need help, you can contact us.
The data collected directly by us via the social media presence will be deleted from our systems as soon as the purpose for storing it no longer applies, you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies. Stored cookies remain on your terminal device until you delete them. Mandatory legal provisions - in particular retention periods - remain unaffected.
We have no influence on the storage period of your data, which is stored by the operators of social networks for their own purposes. For details, please contact the operators of the social networks directly. Finally, links to our accounts on social networks such as Instagram, YouTube, Twitter, Facebook are made in the website. After clicking on the embedded graphic, you will be redirected to the page of the respective provider, i.e. only then will user information be transmitted to the respective provider. If you are logged into the corresponding social network with your user profile, an association with the visit to our website takes place after the button is activated. If you do not want the social networks to collect data about the website, you should log out of the social networks accordingly before visiting the website.

V.6. YouTube video integration

We have embedded YouTube videos on our website, which are hosted by YouTube but can be played directly from our website. YouTube is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). This service is inactive by default, but can be activated by the user. If you call up a sub-page on our website with an embedded YouTube video, general framework data such as your IP address can be transmitted back to Google through the embedding technology. Google processes the IP address of users because without the IP address they cannot send the content to their browser. If you consent to the data transfer to Google, we have no influence on how Google uses the data. Google may, for example, use so-called pixel tags for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer. YouTube may store your data as usage profiles and use them for the purposes of advertising, market research and / or tailored design of their offers. If you do not wish the collected and transmitted information to be associated with your profile on YouTube or Google, you must log out before playing the video. The legal basis for the integration of the YouTube service on our website is your consent pursuant to Art. 6 para. 1 lit. a) DSGVO.

If you do not want cookies to be stored on your end device by YouTube videos, you can prevent this through your privacy settings in the "Personalization" category (Here you can access the corresponding cookie settings).

Further information on data processing and notes on data protection by YouTube or Google can be found at: www.google.de/intl/de/policies/privacy/.

Settings for the display of advertisements on Google can be found at: https://adssettings.google.com/authenticated

V.7. Google Maps

On our website we also use Google Maps (API), another service of Google LLC. Google Maps is a web service for the display of interactive (land) maps to visually display geographical information.

Already when calling up those sub-pages in which the map of Google Maps is integrated, information about your use of our website is transmitted to Google servers in the USA and stored there, this applies in particular to your IP address. This occurs regardless of whether you have a Google user account and are logged into it, or whether there is no user account. If you are logged in to Google, your data may be assigned directly to your account.

The data processing is based on our legitimate interests, namely our interest in the analysis, optimization and operation of our online offer within the meaning of Art. 6 para. 1 lit. f) DSGVO. Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law. Detailed information on data protection in connection with the use of Google Maps can be found on the Google website: https://www.google.de/intl/de/policies/privacy/

V.8. Online advertising (retargeting/remarketing)

We also use retargeting/remarketing services from third-party providers to optimize our offer on the website. For this purpose, data is collected on the website on the basis of cookie/tracking technology to optimize advertising and the entire online offering. This data is not used to identify you personally, but is used solely to evaluate the use of the website and to target users who have already shown interest in content and offers with interest-based advertising on the website and on other websites and social media offers of our partners. The insertion of advertising on the website or on the websites of partners is based on an analysis of previous usage behavior. According to the providers of the services used, usage profiles are generally created anonymously or pseudonymously. We also do not combine this data with other stored personal data at any time. Which third-party providers we work with, how user data is processed in this context and how you can deactivate retargeting/remarketing technologies are explained in the following sections.

a) The website uses Google Ads (formerly Google AdWords). Ads is an online advertising program of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Within the framework of Google Ads, we use so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. These cookies do not serve to identify the user. However, if you visit certain pages of this website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. The information collected using the conversion cookie is used to create conversion statistics for Ads customers who have opted in to conversion tracking. Clients learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive information that can be used to identify individual users. If you do not wish to participate in the tracking, you can object to its use by deactivating the Google conversion tracking cookie via your internet browser under user settings. You will then not be included in the conversion tracking statistics.

The use of this tracking tool is based on your consent in accordance with Art. 6 (1) a) DSGVO.

If you do not want cookies to be stored by Google Ads on your terminal device, you can prevent this through your privacy settings in the "Personalization" category (Here you will be taken to the corresponding cookie settings).
You can also prevent the storage of cookies by Google Ads by setting your browser software accordingly:
https://support.google.com/chrome/answer/114836?co=GENIE.Platform%3DDesktop&hl=de

More information on Google Ads and Google Conversion Tracking can be found in Google's privacy policy: https://policies.google.com/privacy.

b) We also use the online marketing tool Campaign Manager (formerly Google DoubleClick) of the provider Google on our website. Campaign Manager uses cookies to present you with advertisements that are relevant to you. Campaign Manager is characterized by the fact that ads are displayed in real time based on presumed user interests. When our website and other websites on which the Google advertising network is active are called up, a code is executed by Google and so-called (re)marketing tags are integrated into the website. With their help, an individual cookie is stored on the user's device, in which it is noted which web pages the user has visited, as well as technical information about the browser and operating system, referring web pages, time of visit and other information about the use of the online offer. The IP address of the user is also recorded, whereby this is shortened within the Member States of the European Union or another state party to the Agreement on the European Economic Area and only in exceptional cases is it transferred in full to a Google server in the USA and only shortened there. User data is processed pseudonymously within the Google advertising network, i.e. Google does not store and process the name or email address of the user, but processes the relevant data cookie-related within pseudonymous user profiles. This does not apply if a user has expressly allowed Google to process the data without this pseudonymization.
The processing of your personal data is based on your consent within the meaning of Art. 6 (1) a) DSGVO.

If you do not want Campaign Manager to store cookies on your terminal device, you can prevent this through your privacy settings in the "Personalization" category (Here you can access the corresponding cookie settings).

Insofar as data is transferred to the USA, so-called standard contractual clauses in accordance with Art. 46 DSGVO for Google advertising services have been concluded with Google as suitable guarantees(https://privacy.google.com/businesses/processorterms/mccs/ ) . Google is also certified under the Privacy Shield agreement.

Further information on Campaign Manager can be found at https://www.google.de/doubleclick and on data protection at Google in general: https://www.google.de/intl/de/policies/privacy.

c) Within our website, the so-called Facebook pixel of the social network Facebook, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), is used. With the help of the Facebook pixel, it is possible for Facebook, on the one hand, to determine the visitors to our online offer as a target group for the display of advertisements (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our offer or who have certain characteristics (e.g. interests in certain topics determined on the basis of the websites visited) that we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of users and do not have a harassing effect. With the help of the Facebook pixel, we can also track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad (so-called "conversion").

The use of Facebook technologies on our website is based on your consent pursuant to Art. 6 (1) a) DSGVO. We will only use the data obtained to advertise our products and will not pass it on to third parties.
If you do not want cookies to be stored by Facebook Pixel on your end device, you can prevent this through your privacy settings in the "Personalization" category (Here you will be taken to the corresponding cookie settings). You can also prevent the collection by the Facebook Pixel and the use of your data to display Facebook Ads. To adjust which types of ads are displayed to you within Facebook, you can visit the page set up by Facebook and follow the instructions there regarding the settings for usage-based advertising.

Insofar as data is transferred to the USA, so-called standard contractual clauses in accordance with Art. 46 DSGVO for Facebook business tools have been concluded with Facebook as suitable guarantees(https://www.facebook.com/legal/EU_data_transfer_addendum ). Facebook is also certified under the Privacy Shield agreement.
Further information on data processing by Facebook can be found in Facebook's privacy notices at: https://de-de.facebook.com/about/privacy/.

d) On our website, we use the conversion tracking technology of the provider LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland ("LinkedIn"). LinkedIn's technology allows us to show you more relevant advertisements based on your interests. We also receive aggregated and anonymous reports from LinkedIn of ad activity and information about how you interact with our website. For this purpose, LinkedIn uses a Javascript code (Insight tag), which in turn places a cookie in your web browser or uses a pixel. Via the LinkedIn Insight tag, data about the use of our website is collected, including URL, referrer URL, IP address, device and browser properties, timestamps and page views. LinkedIn does not share personally identifiable information with the website owner, but only provides aggregate reports about website audience and ad performance.

The use of LinkedIn technologies on our website is based on your consent pursuant to Art. 6 (1) a) DSGVO.

In connection with the use of LinkedIn Conversion Tracking, the information collected is also processed on servers of LinkedIn Inc. in the USA. Insofar as data is transferred to the USA, so-called standard contractual clauses pursuant to Art. 46 DSGVO have been concluded with LinkedIN as suitable guarantees. LinkedIn is also certified under the Privacy Shield agreement.

If you do not want cookies to be stored by LinkedIn on your terminal device, you can prevent this through your privacy settings in the "Personalization" category (Here you can access the corresponding cookie settings). You can also deactivate an evaluation of your user behavior in connection with LinkedIn ads under the following link: https://www.linkedin.com/psettings/guest-controls/retargeting-opt-out . Alternatively, you can prevent the evaluation of your user behavior in connection with LinkedIn by making the appropriate cookie setting in your browser.

Further information on data protection at LinkedIn can be found here: https://www.linkedin.com/legal/privacy-policy#choices

V.9. Google reCAPTCHA

We use the reCAPTCHA function of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google") on our website. This function is primarily used to distinguish whether an entry is made by a natural person or improperly by machine and automated processing. The service includes the transmission of your IP address and possibly other data required by Google for the reCAPTCHA service to Google and is carried out in accordance with Art. 6 para. 1 lit. f) DSGVO on the basis of our legitimate interest in determining the individual, willful access to our online offer and the prevention of abuse and spam. Further information on Google reCAPTCHA and Google's privacy policy can be found at: https://www.google.com/intl/de/policies/privacy/

V.10. Google Tag Manager

For reasons of transparency, we would also like to point out that we use the Google Tag Manager on our website. Google Tag Manager is a solution with which website operators can manage website tags via a uniform interface and thus integrate Google services in particular into their offering. The Google Tag Manager itself (which implements the tags) does not collect or process any personal data.

VI. Offers subject to registration, newsletter and communication

In addition to the purely informational use of our website, we offer various services or functions that you can use if you are interested. For this purpose, you usually have to provide further personal data, which we use to provide the respective service or function as described below.

VI.1. Registration for "myfischer

Users have the option of registering on the "myfischer" partner portal, creating an account and using various digital services via this account. The partner portal is a closed area of the website that users can access only after prior approval. When registering and creating your partner account, you will be asked to provide the following mandatory information, which is marked with an "*":

  • First and last name of the user
  • E-mail address of the user
  • Branch in which the user is active
  • Name and address
  • Password

Without providing this mandatory data, registration and creation of the partner account is not possible. We process the mandatory data provided by you on the basis of Art. 6 Para. 1 lit. b) and f) DSGVO, on the one hand to create your profile and to identify you at each login, and on the other hand to compare and link your data with the data we have in our CRM system. Depending on the service and function you use on the partner portal, further data may be collected and subsequently linked to your existing profile data.

In the course of your registration, you also have the option of providing further information on a voluntary basis, e.g. your telephone number or customer number. These details are not required for registration and the creation of the partner account. However, if you do not provide this data, we may not be able to fully comply with your wishes when using the partner account. If you provide such voluntary information, the processing of this data is based on our legitimate interests in the administration and maintenance of our customer relationships and the optimization of our online services. In this respect, the legal basis is Art. 6 para. 1 lit. f) DSGVO.

If, in the course of registration, you agree to fischerwerke sending you advertising by e-mail, we will process your data in order to send you information about interesting products or services relating to fischerwerke fastening systems on this basis. The legal basis is then your consent in accordance with Art. 6 para. 1 lit. a) DSGVO. You can revoke your consent at any time. A short message to us is sufficient for this purpose. For more information, please refer to the section on data subject rights below in item 8.

VI.2. Trainings/Seminars

On the website you have the possibility to register for our numerous trainings and seminars. When registering, the following mandatory information is requested and stored by means of a form:

  • First name
  • Last name
  • Telephone
  • E-mail address
  • Company
  • Address

Without providing this mandatory data, registration for our seminars is not possible. In the course of registration, you also have the option of voluntarily providing additional information such as title, department, etc. Please note that this information is not required for registration and you alone decide whether you wish to provide this data. We process the collected data on the basis of Article 6 para. 1 lit. b) DSGVO in order to create you with your account, to identify you and to fulfill the usage contract with you. We delete the data provided by you as soon as the purpose of collection ceases to apply completely and no further legal basis intervenes (e.g. further processing of the data is or becomes necessary for the fulfillment of a concluded contract). If and as long as there are legal obligations to retain data, we will delete the data only after the relevant periods have expired.

VI.3. Newsletter

To register for our newsletter, it is sufficient to provide your name and email address. We send newsletters only after corresponding registration, i.e. with your consent on the basis of Art. 6 para. 1 lit. a) DSGVO. Insofar as the contents of the newsletter (i.e. the advertised goods and services) are specifically described in the registration, they are decisive for the scope of the consent. In addition, our newsletters contain information about our products, offers, promotions and / or our company.

Registration takes place by means of the so-called double-opt-in procedure, i.e. after your registration you will receive an e-mail in which you are asked to confirm your registration in order to prevent misuse of your e-mail address. We log the registration for the newsletter in order to be able to prove the registration process in accordance with the legal requirements and, if necessary, to prevent or clarify any misuse of your personal data. The logging of the registration process is based on our legitimate interests pursuant to Art. 6 para. 1 lit. f) DSGVO in the operation of a user-friendly and secure newsletter system and to be able to prove the registration process and the consent given later.

You can revoke your consent to receive our newsletter at any time, in particular by unsubscribing from the newsletter. You will find an unsubscribe link to exercise this right at the end of each newsletter. If you have only subscribed to our newsletter, your personal data will be deleted again if you unsubscribe.

Our newsletters contain so-called tracking pixels (web bugs), which enable us to recognize whether and when an e-mail was opened and which links in the e-mail were followed by the personalized recipient. We store this data so that we can optimally tailor our newsletters to the wishes and interests of our subscribers. Accordingly, the data thus collected is used to send personalized newsletters to the respective recipient.

We ask for your consent in this regard at the appropriate point. With the revocation of the consent to receive the newsletter, the consent to the aforementioned tracking is also revoked.

VI.4. Other contact - contact form

If you provide us with personal data by e-mail or via a contact form, this is always done on a voluntary basis. Your information will be processed by us for the purpose of processing your contact request and its handling or for order processing pursuant to Art. 6 para. 1 lit. b) DSGVO and may also be passed on to affiliated companies or third parties in this context. To this extent, the information may also be stored by us in our Customer Relationship Management (CRM) system. The provider of our CRM is the company Sitecore, 101 California Street Floor 16, San Francisco, CA 94111. We delete the data provided by you as soon as the purpose of collection ceases to apply completely and no further legal basis intervenes (e.g. further processing of the data is or becomes necessary for the performance of a concluded contract). If and as long as there are legal obligations to retain data, we will delete the data only after the relevant periods have expired.

When users leave comments or other contributions on our website, their IP addresses are stored for 180 days on the basis of our legitimate interests as defined in Art. 6 (1) f) DSGVO. This is done for our security in case someone leaves unlawful content in comments and posts (insults, prohibited political propaganda, etc.). In this case, we ourselves may be legally responsible for the comment or post and are therefore interested in the identity of the author.

VI.5. Comment / Blog function

We offer you the possibility on our site to leave comments on the individual contributions. The IP address of the author/contact holder is stored. This storage is for our security in the event that the author's comments infringe upon the rights of third parties and/or illegal content is posted, as we can be prosecuted for illegal content on our website, even if it was created by users.

A passing on to third parties does not take place. A comparison of the data collected in this way with data that may be collected by other components of our site also does not take place.

We also offer you the option on our site to subscribe to subsequent comments on a post on which you post a comment. If you choose this option, you will receive a confirmation email verifying that you are in fact the owner of the email address provided. The decision to subscribe to such follow-up comments can be revoked at any time. Details of this can be found in the confirmation e-mail. The data obtained in this way will not be passed on to third parties. A comparison of the data collected in this way with data that may be collected by other components of our site also does not take place.

VI.6. Job advertisements / Online application

In addition to our privacy policy, we would like to clarify it with regard to the processing of your personal data and your rights in connection with your application as follows: Data protection information for the application process

You also have the option of providing further information on a voluntary basis, e.g. your telephone number. This information is not required for the use of the VHF System Configurator. If you provide such voluntary information, the processing of this data is based on the legitimate interests of fischer Systemtec GmbH in the administration and maintenance of its customer relationships and in the optimization of the online service. VI.9. Chat function

We use the chat function of Microsoft Teams of Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown Dublin 18, Ireland on some pages of our website. The chat and the associated data processing are only started if you have previously agreed to this in the cookie banner. By default, the chat is not loaded and therefore no personal data is collected from you. Your IP address collected during chat use is stored in anonymous form in the cookies and is not used to identify you personally.

Our chat will help you with any questions you may have about the training opportunities offered by the fischer group of companies, as well as with your search for suitable training positions. Participation in the chat is voluntary and possible without registration. You alone decide what personal data you disclose about yourself in the chat. In particular, you do not have to give your real name, but can also use the chat anonymously by entering a pseudonym in the "Name" field. The data you provide will be processed solely for the purpose of conducting the consultation and ensuring its quality. For the execution of the chat, only data that is necessary for the consulting service or for the completion of your request will be used. This data is processed exclusively by us and our service providers. The transmission of the data is encrypted. Technical and organizational security measures are used to protect the data from intentional or accidental manipulation, access by unauthorized persons, alteration, loss and destruction. The processing of data by Microsoft takes place on servers in the EU and exclusively on our behalf and on the basis of a contract for order processing. Furthermore, we have concluded the standard contractual clauses with Microsoft for the legitimization of a third country transfer that may take place.

The legal basis for the processing of the automatically collected metadata as well as the data voluntarily provided by you in the chat history is your consent pursuant to Art. 6 (1) a) DSGVO. You give us this consent by accepting the necessary cookies and voluntarily providing personal data in the chat. Insofar as the chat is in connection with a potential job application with us, the legal basis for the processing is Art. 6 (1) (b) DSGVO or Section 26 (1) BDSG. Here, we only use your personal data to answer your questions. The chat history is not linked to a specific application. In addition, we use the input to improve our consulting services and for quality assurance. In this respect, we process your personal data on the basis of Art. 6 (f) DSGVO. Our legitimate interest in processing the collected data also lies in the continuous improvement of our consulting services in the context of the chat.

The data collected in connection with the chat will be deleted or blocked by us as soon as the purpose of storage ceases to apply. A storage can take place beyond that, if this is prescribed by the European or national legislator. Data will also be deleted or blocked if a legally prescribed storage period expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract. In the case of consent, you have the right to revoke it at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.

VII. Recipients of personal data

Within our company, only those persons have access to personal data who require this for the respective stated purposes. We only pass on your personal data to external third parties if this is necessary for the processing or handling of your request, if there is another legal permission or if we have your consent for this.

Data transfer within our group of companies takes place for sales and marketing purposes on the basis of our legitimate interests pursuant to Art. 6 (1) f) DSGVO.

External recipients may include, in particular, affiliated companies or external service providers that we use as our processors for the provision of services, for example in the areas of technical infrastructure and maintenance of our website. These processors are carefully selected and regularly reviewed by us. They may only use the data for the purposes specified by us and in accordance with our instructions.

Furthermore, it is possible that we have to transmit personal data to authorities and state institutions, such as public prosecutors, courts or tax authorities, for legally compelling reasons. In this respect, the transmission takes place on the basis of Art. 6 para. 1 lit. c) DSGVO.

Furthermore, we may pass on your personal data to third parties if participation in promotions, competitions, conclusion of contracts or similar services are offered by us together with partners or service providers (e.g. transport service providers). In these cases, the transfer of data is based on consent, for the performance of a contract with you or for the protection of our legitimate interests pursuant to Art. 6 para. 1 lit. a), b) and / or f) DSGVO. You will receive more detailed information in this respect when providing your personal data in connection with the specific processing operation.

VIII. Data processing in third countries

If data is transferred to entities whose registered office or place of data processing is not located in a member state of the European Union or in another state party to the Agreement on the European Economic Area, we will ensure prior to the transfer that, outside of exceptional cases permitted by law, either an adequate level of data protection exists at the recipient (e.g., through an adequacy decision by the European Commission, through suitable guarantees such as the agreement of so-called EU standard contractual clauses of the European Union with the recipient) or your consent to the data transfer has been obtained.

IX. Storage duration

Please refer to the respective description of the corresponding offer or service for the storage period of personal data. In addition, or unless otherwise stated in the respective description of the offer or service, the following generally applies: We store your personal data only as long as this is necessary for the fulfillment of the processing purposes or - in the case of consent - as long as you have not revoked your consent. In the event of an objection, we will delete your personal data unless its further processing is permitted under the relevant legal provisions. We also delete your personal data if we are obliged to do so for legal reasons. If and as long as there are legal obligations to retain data, we will delete the data only after the relevant periods have expired.

  • Objection to data processing on the legal basis of "legitimate interest": you have the right to object to data processing by us at any time for reasons arising from your particular situation, insofar as this is based on the legal basis of "legitimate interest". If you exercise your right to object, we will stop processing your data unless we can demonstrate compelling legitimate grounds for further processing that override your rights. You can also find information on the numerous options for objecting to automated data processing on our website above under section 3 in the descriptions of the respective services/functions we use.
  • Revocation of consent: If you have given us consent to process your data, you can revoke this consent at any time with effect for the future.

The lawfulness of the processing of your data until the revocation remains unaffected.

To do so, you can contact the data protection authority responsible for your place of residence or country or the data protection authority responsible for us.
The rights described above are only available to you on condition that the applicable legal requirements are met, even if this is not explicitly mentioned in the above description.
